1. Agreement to These Terms

By visiting kap10skustoms.com, creating an account, purchasing a product, downloading a file, requesting custom work, or using any service offered by Kap10's Kustoms, you agree to these Terms of Service.

2. About Kap10's Kustoms

Kap10's Kustoms is a small independent business built on craftsmanship, creativity, and customer satisfaction. We strive to treat every customer fairly and ask that customers extend the same respect in return.

3. Products and Services

Kap10's Kustoms may offer digital products, American Truck Simulator and Euro Truck Simulator content, truck skins, trailer skins, digital downloads, laser engraved products, 3D printed items, physical products, custom projects, commissioned work, and future products or services.

4. Customer Accounts

Some features may require an account. You are responsible for keeping your login information secure and for all activity under your account. Kap10's Kustoms may suspend or restrict accounts involved in fraud, abuse, unauthorized sharing, chargeback misuse, or violation of these terms.

5. Digital Products

Digital products are delivered electronically. After purchase, customers may receive access through an instant download link, account download page, email, or another digital delivery method.

A digital purchase provides a license to use the product. It does not transfer ownership, copyright, source files, design files, artwork rights, or redistribution rights.

6. Digital Product Restrictions

You may not:

• Share, upload, distribute, leak, or give away purchased files.
• Resell purchased digital products.
• Include purchased files in free or paid mod packs.
• Upload purchased files to Steam Workshop, Discord servers, file-sharing websites, marketplaces, or other platforms.
• Claim Kap10's Kustoms work as your own.
• Reverse engineer, extract assets from, modify for redistribution, or repackage digital products without written permission.
• Remove branding, notices, license files, or included documentation where present.

7. Compatibility

Digital products are intended for the game, platform, truck, trailer, mod, or version stated on the product page at the time of purchase. Game updates, third-party mod updates, missing dependencies, mod conflicts, user installation errors, or unsupported game versions may affect compatibility.

Kap10's Kustoms may provide updates when practical, but does not guarantee lifetime compatibility with every future game update, third-party mod update, or software change.

8. Updates

Product updates may be provided at Kap10's Kustoms' discretion. Unless clearly stated otherwise, a purchase does not guarantee lifetime updates, unlimited revisions, or indefinite support.

9. Physical Products

Physical products may include engraved items, signs, nameplates, gifts, 3D printed parts, accessories, and other custom or ready-made items. Product photos, colors, materials, dimensions, and finishes may vary slightly due to screen settings, material variation, fabrication processes, and handmade or custom production methods.

10. 3D Printed and Engraved Items

3D printed items may have layer lines, small surface imperfections, support marks, minor dimensional variation, or other characteristics common to the printing process. Laser engraved items may vary based on wood grain, slate texture, metal coating, acrylic color, and material differences. These natural and process-related variations are not defects unless the item is materially different from what was ordered.

11. Custom Work

Custom work may include digital design, ATS/ETS2 skins, engraving, 3D printing, fabrication, prototypes, personalized products, and one-off projects. Quotes, timelines, mockups, and estimates are based on the information provided by the customer and may change if the scope changes.

Custom work may require approval, communication, reference files, measurements, deposits, or final payment before completion or delivery. Kap10's Kustoms may refuse or cancel custom work requests that are abusive, illegal, unsafe, infringing, unclear, outside current capabilities, or not a good fit for the shop.

12. Customer-Supplied Content

If you provide names, logos, artwork, reference images, designs, brands, screenshots, files, or other materials, you confirm that you have the right to use them. You are responsible for any permissions, trademarks, copyrights, licenses, or approvals required for customer-supplied content.

Kap10's Kustoms may refuse projects that appear to infringe another party's rights or violate these terms.

13. Pricing and Availability

Prices, product availability, product descriptions, and services may change at any time. Kap10's Kustoms reserves the right to correct pricing errors, cancel orders affected by obvious mistakes, discontinue products, update listings, or refuse orders when necessary.

14. Payment

Payments are processed through third-party payment providers such as Stripe. By purchasing, you agree to provide accurate billing and contact information. Orders may be delayed or canceled if payment fails, is reversed, appears fraudulent, or cannot be verified.

15. Refunds

Refunds are handled according to the Refund Policy posted on this website. Digital downloads are generally not refundable after successful delivery except where required by law or where Kap10's Kustoms determines that a refund is appropriate due to a verified issue.

16. Chargebacks and Payment Disputes

Customers should contact Kap10's Kustoms first if there is an issue with an order. Fraudulent, abusive, or bad-faith chargebacks may result in revoked download access, account suspension, cancellation of pending work, refusal of future service, and submission of order/download records to the payment processor as evidence.

17. Intellectual Property

All original designs, product images, digital files, website content, logos, text, graphics, artwork, product names, and creative work made by Kap10's Kustoms remain the property of Kap10's Kustoms unless otherwise stated in writing.

18. Prohibited Use

You may not use this website, products, or services to:

• Commit fraud or attempt unauthorized access.
• Distribute malware, spam, or harmful content.
• Harass, threaten, abuse, or exploit others.
• Violate copyright, trademark, privacy, or other rights.
• Interfere with the website, payment systems, downloads, accounts, or security.
• Misrepresent your identity, ownership, permissions, or payment authorization.

19. No Warranty

Products and services are provided as-is unless otherwise stated. Kap10's Kustoms makes reasonable efforts to provide quality work, accurate listings, and functional downloads, but does not guarantee that every product will meet every customer's personal expectations, game setup, mod load order, device, software environment, or future compatibility requirement.

20. Limitation of Liability

To the fullest extent permitted by law, Kap10's Kustoms is not responsible for indirect, incidental, special, consequential, or punitive damages, including lost profits, lost data, game issues, software conflicts, save file problems, lost time, or damages caused by misuse, unsupported setups, third-party software, third-party mods, or customer installation errors.

21. Right to Refuse Service

Kap10's Kustoms reserves the right to refuse service, cancel orders, suspend accounts, revoke access, or decline custom work when necessary due to fraud, abuse, harassment, illegal activity, policy violations, payment issues, safety concerns, or unreasonable demands.

22. Force Majeure

Kap10's Kustoms is not responsible for delays or failures caused by events outside reasonable control, including internet outages, hosting outages, payment processor issues, shipping delays, supply shortages, natural disasters, illness, equipment failure, software outages, or other unexpected events.

23. Changes to These Terms

These Terms may be updated as Kap10's Kustoms grows or as products, services, laws, or business needs change. Continued use of the website or services after changes are posted means you accept the updated terms.
